6. AI Service Usage and OpenAI API

Tucope utilizes OpenAI's ChatGPT API and other third-party AI services to provide intelligent financial insights. By using the Service, you acknowledge and agree to the following:

• Third-Party Services: AI features are provided through third-party services, and we are not responsible for the availability, accuracy, or performance of these services
• Data Processing: Your financial data may be processed by third-party AI services to generate insights. This processing is subject to our Privacy Policy
• No Guarantee of Accuracy: AI-generated insights and recommendations are provided for informational purposes only and do not constitute financial, legal, or tax advice
• Service Availability: AI features may be temporarily unavailable due to third-party service outages, maintenance, or rate limiting
• Cost Management: We reserve the right to implement usage limits, rate limiting, or other restrictions to manage costs associated with AI service usage
• OpenAI Terms: Your use of AI features is also subject to OpenAI's Terms of Use and Privacy Policy

7. Detection of Abuse, Bots, and Spam

Tucope employs automated systems and monitoring to detect and prevent abuse, including but not limited to:

• Pattern Detection: Automated detection of unusual usage patterns, repetitive requests, or behavior consistent with bots or automated scripts
• Rate Limiting: Monitoring and limiting the frequency of requests to prevent abuse
• Anomaly Detection: Identifying accounts that exhibit behavior inconsistent with normal human usage
• IP and Device Tracking: Monitoring IP addresses and device identifiers to detect suspicious activity
• Account Analysis: Analyzing account activity, usage patterns, and data to identify potential abuse

If our systems detect activity that we reasonably believe constitutes abuse, spam, bot usage, or violation of these Terms, we reserve the right to take immediate action, including but not limited to:

• Temporarily or permanently suspending your account
• Limiting or restricting access to AI-powered features
• Terminating your account without notice
• Blocking your IP address or device
• Reporting abuse to relevant authorities or third-party service providers

8. Account Suspension and Termination

We reserve the right, in our sole discretion, to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Service
• Abuse, spam, or misuse of AI-powered features
• Use of bots, automated scripts, or other automated means to access the Service
• Circumventing usage limits or attempting to exploit the Service
• Fraudulent, illegal, or harmful activity
• Providing false or misleading information during registration
• Sharing your account credentials with others
• Any activity that we determine, in our sole discretion, violates the spirit or letter of these Terms

Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data, subject to our data retention policies as outlined in our Privacy Policy. We are not obligated to provide you with a copy of your data upon termination, though you may request data export prior to termination.

9. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Tucope and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of your financial data and any content you upload to the Service. However, by using the Service, you grant Tucope a worldwide, non-exclusive, royalty-free license to use, store, process, and display your data solely for the purpose of providing the Service to you.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

10. User Content and Data

You are solely responsible for the accuracy, legality, and appropriateness of all data and content you submit to the Service. You represent and warrant that:

• You own or have the necessary rights to all data and content you submit
• Your data and content do not violate any third-party rights, including intellectual property, privacy, or publicity rights
• Your data and content comply with all applicable laws and regulations
• You will not submit any malicious code, viruses, or harmful content

11. Payment Terms

If you purchase a subscription or premium features, the following terms apply:

• Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually) as selected by you
• Payment: You agree to provide current, accurate, and complete payment information
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Cancellation: You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period

Tucope does not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service or servers are free of viruses or other harmful components
• AI-generated insights or recommendations are accurate, complete, or suitable for your financial situation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUCOPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
